The terms, policies and conditions (collectively known as "Conditions") described below govern the use of this site (referred to as "Divine Mercantile LLC" or "site"). Your use and/or placement of any order indicate your acceptance of these Conditions.

We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. Divine Mercantile LLC will never sell or rent your personal information to any third parties under any circumstances. We will share personal customer information and/or purchase history only with our agents, representatives, service providers and contractors for limited purposes, including but not limited to, fulfilling customer orders; communicating to customers; providing customer service; enhancing and improving customers' shopping experience; administering or facilitating surveys or contests; offering targeted marketing communications to users that opted-in to receive such communications; providing a personalized shopping experience; preventing fraud; completing payment method processing and to comply with valid legal procedures, requirements, regulations or statutes.

Our secure servers protect your information using advanced encryption techniques and firewall technology. We utilize a 3dcart shopping cart that features a shared SSL certificate provided by GeoTrust. An SSL-encrypted session starts once you sign in to a secure area of our Web site, such as the checkout or account-management area. An "https://" prefix in the URL and a key or padlock icon in the browser's status bar will indicate that the page you are currently on is secure.

To keep you informed about our latest offers, we may notify you of current promotions, specials and new additions to the Divine Mercantile LLC site. You may unsubscribe from our newsletters by following the unsubscribe instructions in any email you receive from us.

When entering any of our contests or prize drawings, you provide your name, email address and mailing address. If you win, we will send the prize to the address entered and notify you by email. When you enter a contest or drawing, you are also included in our newsletter list to receive notice of promotions, specials and new additions to the Divine Mercantile LLC site. You may unsubscribe from this news list by following the unsubscribe instructions in any email received.

We use "cookies" to keep track of your current shopping session to personalize your experience and so that you may retrieve your shopping cart at any time.

Other sites accessible through our site have their own privacy policies and data collection practices. Please consult each site's privacy policy. Divine Mercantile LLC is not responsible for the actions of third parties.

We proudly stand behind all products we sell. If you are not completely satisfied with your item simply return the unused item within thirty (30) days and we will refund your original purchase price less the original shipping/handling charges. Items must be returned in accordance with our Return Policy listed below.

Product warranties (when applicable) are strictly between you, the end purchaser and the individual manufacturer and are limited to the manufacturer's terms and conditions.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Divine Mercantile LLC reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item. After placing an order using our shopping cart, we will check the information you provide to verify availability of your method of payment or shipping address. If we reject your order for any reason, we will attempt to notify you using the information you provided as contact information. Your credit card or PayPal account will normally not be charged if we reject an order, but we will process a refund if a charge has been made against your card or account.

If a customer wishes to cancel their order, they must contact us within 24 hours of when the order was originally placed. The request to cancel an order must be in writing, therefore, the customer must either utilize our websites “contact us” form or e-mail the request directly to info@divine-mercantile.com. The request for order cancellation must include the original order number (example: DM-12345). Due to our orders being processed by various warehouses across the country, cancelling an order will not be possible after the initial 24-hour time-period. Under no circumstance may an order be cancelled after it has been shipped.

We accept the following credit cards: Visa, MasterCard, American Express and Discover. There is no surcharge for using your credit card to make purchases with Divine Mercantile LLC. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. We also accept payments from your PayPal account. We do not accept checks or money orders of any kind.

Shipping & Handling Policy

We will only ship to a physical address. We do not ship to P.O. Boxes, Military Mail Boxes (no APO'S or FPO'S) etc. The purchaser pays all shipping, handling and insurance charges when applicable. We only ship to the U.S. (48 contiguous states only). Our items ship standard ground service or by U.S. mail depending on weight and size. We utilize the UPS shipping calculator to determine our shipping charges, however, the choice of shipping method/carrier is at the sole discretion of Divine Mercantile LLC. Most orders are processed and shipped within five (5) business days. Certain orders may take longer. Business days do not include Saturdays, Sundays or Holidays. We do not guarantee order processing time or delivery time for orders. Please consider any shipping or transit time offered to you by Divine Mercantile LLC or other parties only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.

SPECIAL NOTE: If your delivery address is an apartment, suite or any address that requires a unit number in addition to the regular street address number, we may require a signature for delivery confirmation. It will be the recipient’s responsibility to arrange for someone to sign for the delivery. Furthermore, the recipient will be responsible for any additional shipping charges incurred to obtain a signature for delivery, to correct an address, to re-route a delivery to an alternate address or to have a returned order delivered a second time.

Please be advised that some of our extremely large stockpots may require shipment via freight line instead of standard UPS ground delivery. In the event your order does require shipment via freight line, we will contact you via e-mail or phone and advise you of any additional shipping charge or transit time that might be required. Shipping via freight line also requires delivery to an address which has a loading dock; otherwise there will be a liftgate fee incurred in addition to the regular shipping fee for dropping the delivery at the curb of a residential address.

Please inspect all shipments upon receipt. All claims for damaged goods must be filed directly with the delivering carrier. Please retain all original cartons for inspection by their claims agent. Divine Mercantile LLC is not responsible for items damaged during delivery. At the sole discretion of Divine Mercantile LLC, damaged items that have been authorized for return via our return policy and verified to have been received damaged may either be replaced or the original purchase price will be refunded less any associated shipping/handling charges. Please note that all claims must be submitted in writing via our "Contact Us" online form or via e-mail sent to info@divine-mercantile.com. We do not accept damage claims over the phone. Once we have been contacted regarding a potential claim, you will be emailed a claim form to initiate a claim. Once we have emailed you a claim form you will need to respond to it within 5 days. If after 5 days we have not received your response we will conclude that you do not wish to proceed with your claim and we will consider your claim closed.

We are not responsible for any shipping delays caused by independent carriers, natural disasters, acts of God or anything else beyond our control. We are not responsible for items lost during shipping.

We will keep you informed of any products that you have ordered that are out-of-stock. On extremely rare occasions, the item(s) you purchased might be out of stock by the time your order is processed. Should this happen you will be contacted as soon as possible via e-mail and advised of the situation. You may choose to have your purchase price refunded or applied towards the purchase of another in-stock item. We do not keep back orders.

Our products ship from various warehouses across the U.S., therefore, if you purchase two or more different items, each individual item may ship from a different location and potentially arrive at different times.

Free Gift with purchase (when applicable)

We may occasionally run a limited time promotion where we offer a “Free Gift with Purchase”. On our Home page, we will list the description of the Free Gift and the minimum dollar amount of the purchase you must make in order to be eligible for the Free Gift. The minimum amount does not include shipping charges or tax. The Free Gift will ship separately from the rest of your order and unless otherwise requested in the additional information section of the order, it will ship to the same address the order ships to. Please allow 2 to 3 weeks for your Free Gift to arrive. In the event we run out of the Free Gift that is listed on the Home page, we reserve the right to substitute a different Free Gift of equal or greater value.

Divine Mercantile LLC shall automatically charge and withhold the applicable sales tax (currently 8.25%) for orders to be delivered to addresses within Texas. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes. Please note that the sales tax is applied to both the item price and any shipping or handling charges.

Please allow up to three weeks for the processing of authorized refunds. Shipping and handling fees are non-refundable. Note: If a return/refund is authorized for any item that was originally shipped out with free shipping, a 10% restocking fee will be deducted from the refund amount due. Approved refunds may only be given to the customer listed on the billing address of your order. If your order was paid by credit card, usually the same card will be credited any refund due. If your refund is issued by check, it must be sent to the billing address listed on the order.

The “retail” prices and “manufacturers suggested retail prices” listed on this website are “reference” retail prices. A reference retail price is the full retail price of the same or similar merchandise offered by department stores, specialty shops and other non-discount sellers; or our suggested retail replacement cost at open stock prices. No representation is hereby made that substantial sales are or will be made at the reference retail price. The reference retail prices were determined at the time each item was listed on this website and may be changed without notice. Reference retail prices are not necessarily our present or former prices and are used to assist our customers in comparative shopping. We suggest that you compare our prices with those offered by others. We believe that our superior quality and warranties make our products the “best buy” every time.

While Divine Mercantile LLC uses reasonable efforts to include accurate and up-to-date information on this store site, Divine Mercantile LLC makes no warranties or representations as to their accuracy. All product descriptions and photos on this site originate from either the product manufacturer or distributor; therefore, Divine Mercantile LLC disclaims any liability as to the accuracy or completeness of each item description and photo. We attempt to display product images shown on this site as accurately as possible; however, we cannot guarantee that the product you receive will match the product’s photo. Furthermore, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using to view the product. Divine Mercantile LLC shall not be liable to you for its failure to perform under these Terms and Conditions to the extent that any such failure results from any cause beyond its reasonable control, including without limitation, acts of God; strike; electrical or power outage; the acts or omissions of a third party; earthquake; weather or other natural disasters; the failure of electronic, mechanical data transmission or communication equipment or services; interconnection, internet service, or data transmission problems; computer viruses, errors, configuration problems or the incompatibility of computer hardware or software; problems with intermediate computer or communications network or facilities or your telephone, cable or wireless service; or unauthorized access, theft, operator errors, acts of terrorism or war or labor disputes.
